Terms of Service

Present Terms of Service (“Terms”) govern your relationship with https:/ai-smm.com/, operated by AI SMM SRL (“Service”, “we”, “us” or “our”) addressed to any and all natural persons using the Service (hereinafter User) the use and payment of which comply with the following conditions.

Please read these Terms carefully before using the Service.

Plan/Option payment signifies absolute and unconditional acceptance of the Offer by the User.

Terms and Definitions:

All terms of the Offer shall be construed in accordance with the User Agreement

Subscriptions – Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

Plan — the sum of the Administrator’s remuneration, corresponding to the functionality provided to the User, as well as the term of service provision. Plan types can be found in the User’s Account.

Option — a paid extra function of the Service not included in the Subscription Plan. It allows the User to expand the functionality of the Service. Option types can be found in the User’s Account.

Incident — an event that is not part of the standard Service operation, which causes disruption to, or reduces the quality of the Service.

Policy

  1. Subject Matter

    1. The Administrator shall provide the User a nonexclusive license to use paid Service functionality, while the User shall pay the Administrator a set remuneration.
  2. Procedure and Extent of Use of Paid Functionality of the Service

    1. In order to enable paid Service functionality, the User shall:
      1. have a registered Account;
      2. pass authorization procedure on the Service;
      3. pay or activate chosen Plan and/or Option.
    2. The User is entitled to use paid functionality of the Service during the term and to the extent defined in their chosen Plan or Option in accordance with its intended functionality.
    3. Access to paid functionality of the Service is automatically activated within one calendar day from the moment of the payment. Access is considered granted as soon as said functionality is activated.
    4. Information on the active Plan, paid Options, and the remaining days of use can be found in Account in the “Billing” tab.
  3. Terms of Use

    1. The rights to paid functionality of the Service are limited by the \”right to use\”. None of the provisions of the Offer imply the transfer of any exclusive rights to the Administrator’s Service to the User.
    2. The right paid functionality of the Service are granted to the User by the Administrator in accordance with period of use of the Plan or Option paid for by the User.
  4. Technical Support

    1. The Administrator shall provide the User with technical support during their use of the Service. The scope and extent of the support, expected response time, and communication channels are defined by the Administrator unilaterally.
    2. Performance efficiency is ensured remotely through administrative servers.
    3. The time of resolving the Incident shall not exceed Ten (10) working days.
    4. The following cases are not considered as Incident:
      1. Any scheduled period of Service unavailability, about which the Administrator notifies User at least One (1) calendar day before.
      2. Periods of Service unavailability for the purpose of maintenance of the Administrator’s technical infrastructure.
  5. Contracting with Legal Persons and Sole Proprietors

    1. The Administrator shall grant access to the paid Service functionality to legal persons and sole proprietors under separate agreement (hereinafter Agreement).
    2. If the User is to conclude the Agreement, the User shall send an email to the Administrator’s address, describing required functionality, term of Service provision, and bank details of the organization represented.
    3. The Administrator is entitled to deny the User the conclusion of the Agreement; the payment shall then be made on behalf of a representative, a natural person, in accordance with the rules defined in the Offer.
    4. The Administrator shall notify the User of the decision that has been made, within three days.
  6. Administrator’s Remuneration

      1. The amount of remuneration due to the Administrator is defined on the basis of Plan and/or Option(s) chosen by the User.
      2. The Administrator shall have the discretion to set discount prices on certain Subscription Plans and/or Options.
      3. The cost of paid functionality on the Service does not include possible Payment Provider fees.

    Payment

      1. Plans/Options payments shall be made by the User through one of the payment methods listed in the Account:
        1. Bank card.
        2. Pay Pal.
        3. 2checkout.
      2. Rewards shall be deemed to have been paid from the moment that the corresponding amount from the User enters the Administrator’s current account.
      3. The User’s payment obligations shall not be deemed fulfilled if the payment has been refunded by the Administrator at the request of the payment provider. In this event, the Administrator is entitled to deny the User all access to paid functionality of the Service from the moment the funds have been recalled.
      4. If the payment is not received by the Administrator within Three (3) days, the User is entitled to provide the Administrator with evidence of the payment transfer and to resolve the situation with the payment provider independently.
      5. The User agrees to receiving a payment receipt following the Administrator’s calculation of the provision of paid functionality of the Service.

    Change Plan

      1. The User is entitled to change their Plan:
        1. by increasing functionality. In which case, either the User shall pay the difference of Plan costs, or the term of the new Plan is to be reduced.
        2. by reducing functionality. In which case, the cost difference shall be calculated and converted into an increase to the term of the new Plan.
      2. At the Administrator’s own discretion, the contents and costs of Plans/Options, excluding those already paid for, may be changed;
      3. The Administrator shall make known any Plan / Option changes by publishing the information on the Service.

    Deactivation of Paid Functionality

    1. If the User ceases the use of paid functionality of the Service, including through a breach of terms of Offer, there shall be no grounds for Plan and/or Option payments to be refunded.
  7. Policy For Transmission Of Payment

    1. Credit card details
      All credit card payments are processed securely through Payment Gateway. Payment by credit card is the only way to place an order. AI SMM does not store any credit card information on its servers.
    2. Payment Information
      When you initially provide or update your payment information, we transmit it via an encrypted connection to a Payment Provider. The Payment Provider uses and processes your payment information in accordance with our Privacy Policy. AI SMM does not store your payment information, other than your zip code and country, which is required for billing and compliance with government regulations.
    3. End User Payment Information
      Your End Users’ payment information may be processed via third party eCommerce Payment Providers with which you integrate your Account, in accordance with such eCommerce Payment Providers’ terms and policies. We transmit your End Users’ complete payment information when they initially provide or update it, only so that we can pass it along to the eCommerce Payment Providers you agree to use. We do not collect or store your End Users’ payment information.
    4. Your Consent
      By using our website, you consent to the collection and use of this information. If we decide to change our privacy policy, we will post those changes so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.
    5. Payment Gateway Info
      We offer Credit Card payments for all our users. Credit Card payments are made directly through a 256-bit SSL Encryption software to ensure your personal details are kept safe. Once again, none of your credit card details are stored.
  8. Parties’ Liability

      1. If the User breaches any terms of Service use, the Administrator is entitled to impose penalties stipulated by the Documentation; and any funds paid under the Agreement shall not be returned.
      2. The Administrator is entitled to compensate the User for an untimely handling of an Incident in the way of a proportionate extension of the term of service provision.
      3. If there are any claims, demands and/or actions against the Administrator regarding the breach of any third party rights, the User takes responsibility to settle them and compensate the Administrator for damage, if any.

    Limitations of Liability

    1. Service is provided “as is”.
    2. The Administrator shall not compensate and be liable for any losses that the User incurs due to:
      1. reasons described in the Documentation;
      2. errors in performance of the software and hardware suites of the payment system. If due to an error the payment is not transferred to the Administrator’s current account, the provider of the e-payment system shall take the responsibility to return the funds to the User.
      3. failures in service provision and/or data processing and storage centers;
      4. The lack of connection of the Server to the Internet and/or the Administrator’s servers on the User’s part.
    3. The liability on the part of the Administrator shall not exceed the amount of remuneration paid by the User for the period within which the breach has occurred.
  9. Refund Policy

    1. Certain Subscription refund requests may be considered by AI SMM on a case-by-case basis and granted at sole discretion of AI SMM.
    2. We will consider a refund request if no more than 48 hours have passed since the payment of the current cycle of your Subscription. Refunds are made to the same payment method as was specified in the original payment. The return period is negotiated separately for each case.
    3. At the end of each Billing Cycle, your Subscription will automatically be renewed unless you or we cancel it prior to the renewal. You may cancel your Subscription either through your online account management page or by contacting our customer support team.
    4. We may cancel your subscription, and will first give you notice that it will not be renewed. We reserve the right to revise the terms of your Subscription, including pricing, upon renewal of your Subscription, and will give you a notice of the revision(s) prior to that renewal. If you do not accept the revision(s), you may cancel your Subscription as stated above. If you do not cancel your Subscription prior to the renewal, you will be bound by the revised terms of the Subscription.
    5. We reserve the right to revise the terms of your Subscription upon renewal of your Subscription and will give you reasonable prior notice of the change to provide an opportunity to cancel the Subscription before the change becomes effective upon the renewal. If you do not accept the change, you may cancel your Subscription as stated above. If you do not cancel your Subscription prior to the renewal, you will be bound by the revised terms of the Subscription.
    6. A valid payment method, including credit card, is required to process the payment for your Subscription. You will need to provide us with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize us to charge all Subscription fees incurred through your account to any such payment instruments.
    7. Should automatic billing fail to occur for any reason, we will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
  10. Settling Disputes and Disagreements

    1. Parties shall follow the pre-court (extrajudicial) procedure of dispute settlement. Claims response time shall be Ten (10) working days from the moment of its receiving by the defendant party.
    2. If the dispute cannot be settled through out-of-court negotiation, then the dispute shall be referred to the court based on the Administrator’s location.
  11. Final provisions

    1. The Administrator is entitled to change or supplement the Offer at any time and without prior notice of User. The new edition of the Offer shall come into force within twenty (20) calendar days of its publication on the Service.
    2. The User shall solely inspect any changes and/or supplements to the terms of the Offer.
    3. If the User continues the use of the Service after the Offer is changed and/or supplemented, the User automatically agrees with, and accepts all changes and/or supplements.
    4. If any provisions of the Offer are for any reason considered invalid or unenforceable, the validity and enforceability of the other provisions shall not be affected.
