Terms of Service

These Terms of Service govern paid plans, credits, billing, automatic renewal and cancellation of the AI SMM service (the “Service”) provided by Individual Entrepreneur Vladislav Nikolaevich Aksenov, registered in the Russian Federation (Krasnodar), trading as “AI SMM” (“AI SMM”, “we”, “us”). They supplement the User Agreement, which applies to all use of the Service. Capitalized terms not defined here have the meaning given in the User Agreement. Personal data is processed under the Privacy Policy, and refunds are governed by the Refund Policy.

By purchasing a plan, credits or any other paid option, you accept these Terms of Service.

1. Plans, credits and options

• Plans. Paid plans give access to features and usage limits (for example, number of channels, team members, posts and AI credits) described on our pricing page and in your account at the time of purchase.
• Credits. AI features consume credits. Credits included in a plan are granted for each billing period and, unless stated otherwise at purchase, do not carry over to the next period. Additional credit packs are valid for the period stated at purchase. Credits have no cash value, cannot be transferred and cannot be exchanged for money, except as provided in the Refund Policy or required by law.
• Free plan and trials. If we offer a free plan or trial, its features, limits and duration are shown when you sign up. If a trial requires a payment method and converts into a paid subscription, we will clearly tell you the price and the date of the first charge before you start the trial, and you can cancel before that date without being charged. Where required by law, we will send you a reminder before the trial converts.
• Access. Access to paid features is normally activated immediately after the payment is confirmed, and in any case within one business day. The active plan, paid options and the end of the current period are shown in Billing.

2. Prices, currency and taxes

• Prices are shown on our pricing page and at checkout in the currency offered for your region.
• Unless stated otherwise, prices do not include taxes. Where we are required to collect sales tax, VAT, GST or similar taxes, they are added at checkout and shown before you pay.
• Your bank or payment provider may charge currency conversion or other fees; these are not controlled by us.
• Promotional prices and discounts apply only for the period and conditions stated in the offer. After that, the regular price applies at renewal, and we will tell you the regular price when you accept the offer.

3. Billing and automatic renewal

• Subscriptions are billed in advance for each billing period, starting on the day of purchase.
• By purchasing a subscription, you authorize us and our payment provider to charge your payment method automatically at the start of each new billing period at the then-current price for your plan, plus applicable taxes, until you cancel.
• Before you pay, we show you: the plan price, the billing period, the fact that the subscription renews automatically until cancelled, and how to cancel. After purchase, we send a confirmation email with these terms and information on how to cancel.
• Annual plans: we will send an email reminder at least 15 and no more than 45 days before an annual subscription renews, stating the renewal date, the amount and how to cancel.
• You must keep your payment information current. Payments are processed by our payment providers (such as RollyPay or PayPal); we do not store full card numbers.

4. How to cancel

• You can cancel automatic renewal online at any time: open Billing in your account and click Cancel recurring. You do not need to call us or contact support. You can also cancel by emailing info@ai-smm.com from the email address of your account.
• Cancellation takes effect at the end of the current paid period. You keep access to paid features until then and you will not be charged again.
• We send you a confirmation of cancellation by email or in the Service.
• Cancelling a subscription does not delete your Account or data. To delete your data, see the Privacy Policy.
• Except as stated in the Refund Policy or required by law, amounts already paid for the current period are not refunded when you cancel.

5. Upgrades and downgrades

• Upgrade: the new plan starts immediately. We either charge the price difference for the remainder of the current period or recalculate the period, as shown at checkout before you confirm.
• Downgrade: the new plan normally starts at the next renewal. If your usage exceeds the limits of the lower plan (for example, number of connected channels), you will need to reduce it before the change takes effect.

6. Price changes

We may change prices for future billing periods. We will notify you by email at least 30 days before a price change applies to your subscription (and, for monthly plans, in any case at least 7 days before the next charge). The new price applies from your next renewal after the notice period. If you do not agree, you can cancel before the renewal. Price changes never apply to a period you have already paid for.

7. Failed payments and chargebacks

• If an automatic payment fails, we may retry the charge and will notify you. If payment is not completed within 7 days, paid features may be suspended until payment is received or the Account is moved to a free plan. Your data is not deleted because of a failed payment.
• If you believe a charge is wrong, please contact us at info@ai-smm.com first — we will investigate and correct errors promptly. Filing a chargeback does not affect your legal rights, but we may suspend the Account while the dispute is reviewed.

8. Business customers

• Companies and sole proprietors may request an invoice, a separate written agreement or payment by bank transfer by writing to info@ai-smm.com with the required plan, term and company details. We will reply within 3 business days.
• If you are a business, you are responsible for any taxes that apply to you under reverse-charge or similar rules.

9. Support and availability

• We provide support by email and in-app chat. We aim to respond within 2 business days, and faster for issues that prevent you from using the Service.
• We work to keep the Service available 24/7 but do not guarantee uninterrupted availability unless agreed in a separate written agreement. We try to schedule maintenance at times of low usage and to announce planned downtime longer than one hour in advance.
• If a failure on our side makes the paid Service substantially unavailable for more than 72 consecutive hours, you may request a pro-rata credit or refund for that time.
• Interruptions caused by Connected Platforms (for example, API changes or outages at a social network), your internet connection or force majeure are not failures on our side.

10. Discontinuation

If we discontinue the Service or a paid plan, we will give you at least 30 days’ notice, let you export your data, and refund the prepaid fees for any unused period.

11. Your statutory rights

These Terms do not limit any rights you have under mandatory consumer protection laws, including automatic renewal laws of U.S. states (such as California), the right of withdrawal in the EEA and UK, and consumer rights under Russian law. If a provision of these Terms conflicts with such a law, the law prevails. We comply with the consumer protection laws of every country in which we offer the Service. We have authorized local representatives in the European Union, the United Kingdom and other countries where the law requires it (including representatives under Article 27 of the EU GDPR and UK GDPR).
